Privacy Policy on the recruiting

on the recruiting process of the candidate for further cooperation (as of 01 July 2023)

WHO ARE WE?

Company collects, uses, and in any other way processes information on candidates considered for further cooperation.

After applying or communicating your cooperation with us, you (hereinafter – “Candidate” or “You”) are deemed to have agreed to the terms of the Policy. If the Candidate revokes the consent or objects to certain processing procedures, the Company may not be able to continue the Candidate’s recruiting process for further cooperation.

The Company collects the Candidate’s Personal Data directly from the Candidate and other available sources to the extent permitted by applicable law.

We have the right to change and update the Policy if we consider it necessary, for example, for legal reasons or due to changes in the operating process. We will notify you of any changes made. The current version of the Policy is posted on the ProFee website with the last update date and is valid from the moment of its publication. Changes to the Personal Data processing with consent required shall only apply after voluntary and informed consent is granted.

WHAT DATA DO WE COLLECT AND PROCESS?

The Company collects and processes the following data:

  • full name and contact information (postal address, e-mail address, telephone number, and other contact information);
  • information on work experience (competence, list of previous projects or companies you have collaborated with, functionality in such projects or companies);
  • issuance, titles of educational programs, the effectiveness of their passage;
  • information on skills and special knowledge;
  • demographic data (i.a., date of birth, gender);
  • desires on the format and place of cooperation, preferred methods of communication, as well as other wishes on cooperation from the Candidate;
  • information and data recorded on video during interviews, including materials with the image of the Candidate;
  • other relevant information required to evaluate and decide on the possibility of cooperation.

WHAT PURPOSE IS THE DATA COLLECTED AND PROCESSED FOR?

We collect, process, and/or use the Candidate’s Personal Data to:

  • determine the qualifications for cooperation and decide on the start of cooperation;
  • assess your compliance with the requirements of the projects for which recruitment is planned;
  • confirm Personal Data and verify recommendations and/or pre-verify data (if necessary), including but not limited to:
    • create and conduct surveys and evaluations;
    • evaluate, select, and conclude contracts with candidates;
    • contact third parties in order to validate the recommendations you have provided and assess the possibility of cooperation.
  • enter into cooperation agreements;
  • inform you by e-mail, SMS, or another channel on the status of your request for cooperation, including, but not limited to:
    • obtain additional information if necessary;
    • inform you about available cooperation opportunities;
    • provide you with information on your request.
  • assist in obtaining visas or permits if the Candidate requests it and if necessary;
  • protect the rights, interests, and obligations of the Company;
  • inform you by e-mail, SMS, or another channel about the cooperation formats we believe suit you;
  • inform you about events related to possible cooperation;
  • develop and improve project team collecting processes and other related services. Where possible, we use aggregated anonymous or statistical information in the context of development activities.

Suppose the relevant decision on further cooperation is made. In that case, your Personal Data may be processed for pertinent purposes in the design and implementation of appropriate legal relations and contracts, and their performance may be included in the relevant profile of the project team member in project accounting systems.

We do not collect or use the information you provide for purposes other than those listed above. The Company does not collect, use, disclose, or otherwise process the Candidate’s Personal Data for marketing purposes.

The Candidate’s Personal Data may be processed for other purposes, which the Candidate has explicitly agreed to in each separate case. Whenever necessary and under the mandatory requirements, the Company deletes and/or anonymizes the Candidate’s Personal Data that is no longer required.

WHERE AND HOW LONG IS YOUR DATA STORED?

Personal Data is stored at its owner’s business addresses, specified on the Company’s website in the “Contacts” section.

The Company will retain Personal Data throughout the term of the cooperation and five years after the cooperation termination (unless a more extended period for individual data is established by applicable law).

The Company will retain Personal Data for five years if no agreement has been reached with you.

The Company will only keep the Candidate’s Personal Data for a more extended period than intended to achieve the objectives set out in this Policy and/or required or permitted by law.

TO WHOM AND WHERE IS PERSONAL DATA DEEDED?

Your Personal Data will be used exclusively by and for the Company. However, please note that your Candidate’s Personal Data may be disclosed to:

  • service providers involved for the above purposes. The Company requires the aforementioned companies to provide adequate protection for the Candidate’s Personal Data and not use it for improper purposes.
  • legal entities – administrators, namely ADVANCED HOSTERS B.V., AHPS LTD, ASDC LTD and DATAWEB GLOBAL LP. Given that the responsibility of administrators for the candidate recruiting and the Company’s activities may be partially delegated to other companies of the DATAWEB GLOBAL Group, the Company may transfer or disclose relevant Candidate’s Personal Data to the extent specified by local law to those recipients and for the purposes identified herein.

Candidate data may be used worldwide in line with the Company’s recruitment process. Thus, the Candidate’s Personal Data may be transferred across national borders and accessed by other abovementioned legal entities from countries with different laws providing different levels of protection. Legal entities and service providers that use the Candidate’s Personal Data may be subject to jurisdictions that do not provide the level of protection of the Candidate’s Personal Data compared to the state you are a citizen or resident of. The Company ensures such international data transfers are in accordance with the personal data protection law requirements. The Company will require the Legal Entity or the relevant service provider to provide an adequate level of data protection, as required by applicable data protection law through contract or otherwise. The Company will (i) conduct due diligence on such service providers’ selection and (ii) require, through appropriate contractual procedures, that such service providers take appropriate technical and organizational security measures to protect and process the Candidate’s Personal Data only on behalf of the Company and not under other circumstances. A list of such providers may be provided to the Candidate upon his written request. The Company does not disclose the Candidate’s Personal Data to any third party that is not (a) a Legal Entity of the Group of Companies or (b) a service provider under a written contract without prior notice to the Candidate and positive approval for such disclosure.

Mandatory Disclosure: The Company may require or, as required by local law, disclose the Candidate’s Personal Data to certain authorities or other third parties, such as government agencies or law enforcement agencies. The Company may also disclose and otherwise process the Candidate’s Personal Data under the local law requirements to protect the Company’s legitimate interests, for example, in civil or criminal cases.

HOW IS PERSONAL DATA PROTECTED?

We will use reasonable efforts to take appropriate action against the unlawful processing of the Candidate’s Personal Data and any loss or failure, abuse, unauthorized access, disclosure, correction, or deletion of such data. We will provide procedures and technologies to protect the Candidate’s Personal Data from its collection to deletion. Ensuring the protection of the Candidate’s Personal Data means guaranteeing the confidentiality, integrity, and availability of Personal Data.

We apply our internal policies and guidelines through appropriate measures, including active and responsive risk management, security and privacy engineering, and evaluation. We take reasonable steps to address Internet security, physical security, data loss prevention, and prevention of other similar risks, considering the risks posed by the processing and nature of the protected data. Moreover, we grant access to a database with personal data only to authorized persons with a justified need to access such data. We will support reasonable steps to keep the Candidates’ Personal Data available and remove incorrect or unnecessary personal status. To the extent permitted or required by applicable local law or under the Candidate’s consent, we may use public sources to verify the Personal Data of the Candidates we have arranged are correct.

WHAT RIGHTS DOES THE CANDIDATE HAVE?

You have the right to:

  • access personal information about yourself and acquaintance with it;
  • require the deletion of data about yourself;
  • withdraw consent to processing Personal Data at any time. In this case, all previous processing is considered legal;
  • send inquiries regarding the content of your Personal Data, as well as their correction and updating;
  • other rights provided by applicable law.
